An ICC workshop on International
Commercial Arbitration will take place on 2 – 4 July 2010 for the first time in
Hong Kong, under the auspices of the ICC Institute of World Business Law and in
close collaboration with the ICC International Court of Arbitration.
Drawing upon the experience of renowned arbitrators in
a multicultural and international environment, the training will engage in various
interactive sessions during the workshop. It will also examine the different
stages of the arbitral proceedings under the ICC Rules of Arbitration.
The two-and-a-half day workshop – successfully conducted for several
years in other parts of the world and making its way for the very first time to
Asia -- will meet the practical
needs of those involved in international trade. It will also simulate how ICC
Arbitration functions, highlighting differences in cultures and legal
practices. Participants will develop first-hand experience and knowledge of the
ICC Rules and practice of international commercial
arbitration tools that have become essential in today’s international business
environment.
The workshop is designed for legal directors and
corporate counsel from companies involved in international commercial arbitration, members of the judiciary,
practicing lawyers, legal practitioners who advise international trading
companies, and business people involved in international trade and dispute
resolution.
“Practicing as counsel in international arbitration is
different from practicing in courts,” said Yves Derains, Vice-Chairman of the ICC Institute
of World Business Law. “The rules of the games are not
the same. Practical training such as that offered by the workshop is necessary
to get familiar with such rules of the games.”
The workshop includes a mock case conducted by working
groups each consisting of about 10 – 15 people. The case will be sent to
participants before the workshop so that they can familiarize themselves with the
facts. They will then simulate an arbitration hearing, presenting testimony and
other evidence, and carrying out cross examinations.
The seminar sessions during the workshop will discuss
topics including Asia-Pacific legal
developments, arbitration best practices, the selection and appointment of
arbitrators, and the powers, duties and roles of arbitrators.
