Task Force on Amiable Composition and ex aequo et bono Co-Chaired by Edouard Bertrand (France) and Ronald King (United Kingdom)
The Task Force on Amiable Composition and ex aequo et bono was created in September 2005.
The Task Force was mandated to:
- identify the essential features of amiable composition and of ex aequo et bono; and
- study the role of the arbitrators when acting as amiable compositeurs or when deciding ex aequo et bono (e.g. jurisdictional, procedural or substantive problems that may arise).
The information gathered as a result of the Task Force’s studies will provide the basis for the establishment of a draft report, possibly in the form of notes and/or recommendations.
The Co-Chairs of the Task Force have indicated that the report prepared by ICC France on Amiable Composition will be a useful starting point to think through the problems posed by amiable composition and ex aequo et bono arbitration.
TheTask Force is composed of over 70 registered members from 23 different countries.
Latest News
At the Commission meeting on 24 April, a draft final report was presented by the task force on Amiable Composition and ex aequo et bono to the Commission members for discussion.
Following the discussion, the Chair of the Commission suggested that the task force take a step further in the drafting of the report on the basis of all comments submitted by the members.
